Board of Adjustment

The Board of Adjustment (BOA) is a "Quasi-Judicial" administrative body established per Unified Development Ordinance Section 10.4 and in accordance with North Carolina General Statutes Section 160D-302. The BOA consists of five regular members. Four members are citizens and residents of the City of Burlington who are appointed by the City Council. The remaining BOA member resides outside of the city limits in Alamance County but is within the Extraterritorial Jurisdiction (ETJ) boundaries of the City and is appointed by the Alamance County Commissioners. There are two City alternate members and two ETJ alternate members of the Board.

Per Unified Development Ordinance Section 10.4.A., the BOA has the following powers and duties: appeals of decision by City staff members deciding applications under the UDO, appeals of decisions of the Historic Preservation Commission on Certificates of Appropriateness, Special Use Permits, Water-related Variances, and Zoning and Subdivision Variances.

The BOA has scheduled meetings on the 2nd Tuesday of every month at 8:30 AM (please see the submittal and meeting date calendar here). On occasion, these meetings are subject to change. In accordance with North Carolina Open Meetings Law, notice of a change of any regular meeting date will be posted within 24 hours of the decision being made (see notices here). The date will be italicized and in blue if a change was made.


All variance requests going before the BOA are required to have a Pre-Application Conference (PAC). Both the PAC application and any subsequent BOA applications may be submitted via the City's SmartGov Portal, available here:
