Post Construction Requirements
The National Pollutant Discharge Elimination System (NPDES) Phase II Stormwater Program is an effort to preserve, protect and improve the nation’s water resources from polluted runoff. The program requires Burlington and other municipalities to obtain a federal stormwater permit. The City of Burlington’s permit was issued July 1, 2005.
A requirement of the Burlington permit was the adoption of a post construction stormwater ordinance. The ordinance follows the N.C. Division of Water Quality’s Stormwater Model Ordinance and the Best Management Practices (BMP) Design Manual, and was adopted by the Burlington City Council June 19, 2007.The ordinance was effective July 1, 2007, and affects all new development and redevelopment of one acre or more. A stormwater permit fee of $420 was established by City Council on August 7, 2007.
At the February 5, 2008 City Council Meeting this fee was increased to $505.00, effective March 1, 2008.
An Administrative Manual has been developed to facilitate submittal and review of development plans with respect to the Phase II Post-Construction Stormwater requirements.
Stormwater O&M Inspection Reports
The City of Burlington requires operation and maintenance inspection reports to be submitted for all structural BMPs on an annual basis. Additionally, stormwater BMPs must be periodically inspected per the frequency specified in the recorded operation and maintenance agreement for the facilities.
